About Us Attestation of Will

Step 1- Arrange the following documents:

Indian Citizen

Canadian Citizen

  • Duly filled in Miscellaneous application form (CLICK HERE) along with a photograph pasted on it
  • Will in original and copy. It should not be signed at this stage.
  • Copy of passport/(s) (first and last page)
  • Copy of valid PR card/Work/Study/Visitor permit
  • Address proof- Please enclose any one of the following documents as proof of present address [Phone bills, Bank statements are not accepted as valid address proofs.]:
  • Driving license
  • Photo ID issued by the Provincial Government
  • Utility bills (Gas, Electricity, Water or Landline Telephone Bill displaying applicant’s address / House Lease Agreement).

* Any Apostille WILL document from the Indian passport holder is not required to be submitted at the  BLS for onward attestation by the Consulate.

** Only the non-Apostille document from the Indian passport holder are required to be submitted after following the checklist as mentioned above at the BLS for onward attestation by the Consulate.

India is a signatory to The Hague Apostille Convention, 1961 since 26 October 2004. Canada became a member of the Convention on 11 January 2024.

In accordance with the Convention, any Apostille Certificate (including e-Apostille) issued by a competent authority in Canada requires no further attestation/legalization by Consulate General of India, Toronto.

The charges mentioned are for a single seal & signature of the Consulate. The final amount will depend upon the number of signatures/seals that the applicant requires.

 

Step 2- Submission of application:

  • For attestation of Will, the application needs to be submitted at the nearest BLS center. Please see https://www.blsindia-canada.com/ for more information. Once the application has reached the Consulate, the applicant/(s) and a minimum of 2 witnesses will be called to the Consulate for verification and signing of the Will in presence of a Consular Officer.
  • The following authorities are authorized to issue Apostilles for Canadian documents:

    i. Global Affairs Canada (Ministry of Foreign Affairs Canada)

    ii Ministry of Justice, Government of Alberta

    iii. Ministry of Public and Business Service Delivery, Government of Ontario

    iv. Ministry of Justice and Attorney General, Government of Saskatchewan

    v. Ministry of Attorney General, British Columbia

    vi. Ministère de la Justice du Québec (Ministry of Justice), Quebec.

HOME VISITS:

In case the Will applicant/(s) are unable to come to the BLS centers due to medical reasons, an official of the Consulate can visit the person at residence. Should you wish to utilize this option the requirements are as follows:


1. A person on behalf of the applicant will need to bring in all the documents to the Consulate for a pre-check. This is a walk-in service and you can come on a working day between 0900-1000 hrs.

2. Once documents are in order, an appointment on a suitable date and time will be granted wherein an officer will accompany the person to the residence for verification purposes.

3. Applicant will have to arrange for the conveyance of the officer from Consulate to your residence and vice versa (eg. taxi/cab).

4. In case of will, presence of at least 2 witnesses is also required at the home address

5. The home visit service costs an additional CAD 139 payable by debit card or demand draft in favor of 'Consulate General of India, Toronto'

 

Please Note: If the Will is not registered before the death of the deceased, who has made the Will, it needs to be executed (Probate - A judicial certificate saying that a will is genuine and conferring on the executors the power to administer the estate) by the Court Order from the Court of Ontario and thereafter get the order pre-authenticated as per latest Global Affairs Canada's guidelines (Please see https://www.international.gc.ca/gac-amc/about-a_propos/services/authentication-authentification/step-etape-1.aspx?lang=eng ) and then from Consulate General of India, Toronto.
